Remediation and Replacement Terms

4. Mandatory Buyer Responsibilities

A healthy Akita requires an active partnership between the breeder and the owner. By completing this purchase, the buyer legally agrees to the following care conditions:
  • Complete Veterinary Care: Provide timely, routine, and emergency veterinary interventions, including keeping the Akita properly vaccinated throughout its adulthood.
  • Premium Nutrition: Feed a premium, “no soy” commercial dog food formula specifically manufactured to support the controlled growth rates of large-breed dogs.
  • Shelter and Security: House the dog indoors or within a safe kennel structure featuring adequate shelter at all times. The dog must never be permitted to roam free or unsupervised.
  • Exercise Limitations: The puppy possesses soft, developing growth plates. The buyer agrees not to over-exercise the dog or allow it to navigate large flights of stairs before it reaches 2 years of age to prevent structural hip or elbow irregularities.
  • Breeding Restrictions: The dog must not be bred under any circumstances until all adult health clearances and genetic profiles are completed and approved.
  • Right of First Refusal: If you decide you can no longer keep or care for the dog, you must contact us first. FurriGuardian Pups retains the contractual right of first refusal to reclaim the dog at a price not exceeding the original purchase amount.

5. Legal Indemnification and Liability

  • Transfer of Responsibility: The buyer assumes all legal, financial, and physical responsibility for the dog immediately upon transfer of ownership. The seller cannot be held accountable for any future legal complications or civil ramifications involving this dog.
  • Enforcement Costs: In the event of a contractual breach, the buyer explicitly agrees to pay all of the seller’s court costs, attorney fees, and legal expenses incurred while enforcing this contract.
